1.1 "Lounge Facilities" means the provision of seating with refreshment facilities at Executive Lounge which includes:- Executive Lounge, Platform -1 Executive Lounge, Platform -16 1.2 "Customer" means bonafide Railway passenger booking the usage of lounge facilities. 1.3 "Charges" means the charges paid by the Customer in respect of Lounge Facilities in accordance with charging structure which may be amended by IRCTC from time to time. 1.4 "Additional Facilities" means the facilities not included in 1.1 and mentioned in clause 4.4. 2.1 The lounge facilities are provided by IRCTC subject to these terms and conditions, the acceptance of which the Customer shall confirm and agree by the act of booking the Lounge Facilities and paying the charges. 2.2 No representative, employee or salesperson or agent of IRCTC or its Service Provider has authority to vary, amend or waive any of these conditions. 2.3 These terms and conditions will prevail over any terms or conditions proposed by the Customer orally or on any order form or similar document: and any such other terms and conditions proposed shall not be binding on IRCTC. 3.1 All specifications, descriptions, drawings, photographs or illustrations of the Lounge Facilities and any other advertising matter and sample books are only intended to serve as a guide and not to be relied upon by the Customer or treated as binding or as forming part of these conditions or any contract with the Customer. 3.2 IRCTC shall use its reasonable endeavours to provide the Lounge Facilities during the booking slab, but reserves the right to close the Executive Lounge due to refurbishment: or otherwise in which case an alternative executive lounge facility will be provided or a refund of the Charges will be made at the discretion of IRCTC. 3.3 IRCTC shall use its reasonable endeavours to ensure a suitable environment is maintained in the Executive Lounge including but not limited to keeping the area where Lounge Facilities are provided clean and tidy, ensuring staff are on hand to respond to any queries, of the customer. 4.1 The Entry Fee of Executive Lounge, PF-1 for initial One hour is Rs.169.64/- per person and Executive Lounge, PF-16 for initial 2 hours is Rs.200/- per person "Exclusive of all taxes". However, Bank Charges will be borne by the customer on the booking/cancellation.
4.2 In case the Customer intends to use lounge facilities beyond two hours but limited to 24 hours, an additional amount of Rs.116.07/- and Rs.70/- per person (Exclusive of all taxes) respectively per hour would be charged. 4.3 Children above three feet height shall be treated as person and liable for full charges. 4.4 Charges leviable for additional facilities available at Executive Lounges are as under: I. Executive Lounge, Platform-1:- A.)Paid meals per person exclusive of all taxes in Executive Lounge, PF-1 as follows:- 1. Breakfast buffet (Veg @ Rs 400/- & N. Veg @ Rs 460/- per person) 2. Lunch/Dinner (Veg @ Rs 450/- & Non-Veg @ Rs 500/- per person) 3. Hi-Tea Snacks @ Rs 330/- per person B.) Wash and Change : Rs.280/- per person exclusive of taxes. (Bath kit - comprising of laundered towel, soap, shampoo, shower cap, dental kit, ear buds). C.) Shaving kit : Rs.50/- Extra. D.) Business Centre: II. Executive Lounge, Platform-16:- A.)Paid meals per person exclusive of all taxes in Executive Lounge, PF-16 as follows:- 1. Buffet Breakfast Veg:- Rs.275/- 2. Buffet Breakfast N. Veg. :-Rs 275/- 3. Buffet Lunch Veg:-Rs 399/- 4. Buffet Lunch N. Veg. :-Rs 399/- 5. Buffet Dinner Veg:-Rs 399/- 6. Buffet dinner N. Veg. :- Rs 399/- 7. Hi- Tea(Snacks) :- Rs.210/- B.) Wash and Change 1. Rs.200/- per person exclusive of taxes.(Bath kit) C.) Shaving kit charged Rs.25/- Extra(Dental Kit) D.) Business Centre: 4.5 In case of revision in tariff or otherwise, the customer is liable to pay the difference of charges at the time of check-in. 5.1 Customers shall make payment for the Lounge Facilities when booking by entering the details of their debit or credit card on to the on-line booking form, provide that such credit or debit card is listed as acceptance to IRCTC on the booking form instructions. 5.2 Unless otherwise agreed to in writing, the Customer shall not be entitled to any discount. 5.3 In case Customer intends to make payment for Lounge Facilities in cash, only Indian currency shall be acceptable. 6.1 The customer may book the lounge facilities on line or at the counter of Executive lounge up to 60 days in advance and shall ensure that all fields in the format have been filled in correctly. IRCTC shall not be responsible for any incorrect information provided by the customer. 6.2 The Customer shall be a bonafide Rail passenger having a valid railway ticket at the time of check-in at Executive Lounge. 6.3 Any person accompanying the customer and willing to use Lounge Facilities shall be treated as walk in customer and the entry shall be allowed subject to availability of seat and payment of charges as prescribed. 6.4 The customer must carry a photo identity proof in original which is mandatory for check-in at Executive Lounge. The following documents are recognized for the said purpose viz PAN card, Driving license, Passport, Voter card, Aadhaar Card and Identity card having serial number issued by Central/State Govt or its PSU. 6.5 The Customer shall ensure that he is, at all times, appropriately dressed and shall behave in an appropriate manner. IRCTC and any third party lounge provider with whom IRCTC has entered into an agreement for the provision of Lounge Facilities reserve the right at their sole and absolute discretion to refuse entry or to remove any Customer whose behaviour or mode of dress is considered by IRCTC to be unsuitable or is likely to offend other Customers. 6.6 Customers must not remove food or drinks from the executive lounge facilities and will be asked to refrain from consuming food and/or drinks in the Lounge Facilities other than food and/or drinks provided in the Lounge Facilities. 6.7 The customer agrees to adhere to any no smoking policies in operation in any of the Lounge Facilities. 6.8 Pre-arrival/post-arrival/No show: 6.9 The Customers are advised to report at least 15 minutes in advance for check-in formalities. 6.10 The management of the Executive Lounge shall not be responsible for any delay in arrival due to late running train or any other reason. 6.11 The customer may avail additional facilities as prescribed at the charges mentioned herein above. 6.12 Customers are solely responsible for their own valuables and belongings. Luggage racks are available in the lounge, however, Executive Lounge shall not bear any loss due to damage, theft, etc of luggage or belongings. 6.13 All disputes are subject to the jurisdiction of the Delhi Courts. 7.1 IRCTC shall under no circumstances be liable for any indirect, special or consequential loss including but not limited to loss of profit, loss of contract, loss of revenue or loss of business, howsoever arising whether in contract, tort (including negligence) or statuary duty or otherwise. 7.2 The aggregate liability of IRCTC, whether in contract, tort of including negligence or breach of statuary duty or otherwise to the customer for any loss or damage whether asserted by the Customer or third parties, of whatsoever nature and howsoever caused shall be limited to and in no circumstances shall exceed the Charges paid by the Customer for the Lounge Facilities. 7.3 IRCTC shall under no circumstances be liable for any Customer failing to board his train and neither IRCTC nor any third party Lounge provider with whom IRCTC has entered into an agreement for the provision of Lounge Facilities has any obligation to make train announcements. 7.4 IRCTC shall under no circumstances be liable or responsible for the personal belongings of any Customer, and the customer shall take personal belongings into the Lounge Facilities area solely at his own risk. 7.5 All information, recommendations and advice given by or on behalf of IRCTC to the Customer regarding train details are given without liability on the part of IRCTC. 7.6 The Customer shall fully indemnify and compensate IRCTC, its employees, sub-contractors and agents in respect of all actions, suits, claims, demands, costs, charges or expenses arising whether asserted by the Customer or third party out of or in connection with the provision of the Lounge Facilities which are caused directly or indirectly thorough the act or omission, wilful misconduct or negligence of the Customer. 8.1 IRCTC shall not be liable to the Customer for any loss or damage caused to or suffered by the Customer as a direct or indirect result if the provision of the Lounge Facilities by or on behalf of IRCTC being prevented, restricted, hindered or delayed by reason of any circumstances outside the control of IRCTC. 9.1 The right power and remedies provided pursuant to these conditions are cumulative and do not exclude or affect any rights, powers and remedies provided by law. No delay in exercising, or no exercising IRCTC of any rights or remedies under these conditions shall operate as a waiver or lease of that right, power or remedy. |
